Terms and Conditions

1. GENERAL

a. This website is owned and operated by Conversations – The Cafe (Oars Hospitality & Leisure Limited), New Zealand.

b. Access to this website, placing an order, use of software, or downloading software from this website is conditional upon your acceptance of these Terms and Conditions of Use. These Terms and Conditions affect your rights and should be read carefully.

c. If you do not agree to these Terms and Conditions, please exit the website.

d. Products sold through this website are owned by the Food Provider (Conversations – The Cafe).

e. Conversations Cafe POS is the responsible party processing and approving your online order.

f. “Credit card” means a Visa or MasterCard.

g. “Food Provider” refers to the food establishment that provides the food order to you.

h. “You” or “Your” refers to any person or entity using this website to order goods, and will be subject to these Terms and Conditions.

i. “Website” refers to the website you are accessing in order to place an online order.

2. YOUR RESPONSIBILITY

a. You must read the Privacy Policy and agree to OrderMeal & Conversations Cafe’s use of your personal information in accordance with the Privacy Policy and its obligations under the National Privacy Principles.

b. Ownership of the goods remains with the Food Provider until payment is approved or received.

c. You warrant that you are over 18 years of age.

d. You acknowledge that it is an offence for any person under the age of 18 to buy or attempt to buy intoxicating liquor for themselves or others.
(Note: We do not sell alcohol or tobacco.)

e. You acknowledge that orders for cigarettes or alcohol will not be accepted if you are under 18, and proof of identity will be required upon delivery.

f. You warrant that all personal information provided is accurate. If your personal information changes, you will update your profile immediately.

g. You undertake not to use a false name or impersonate another person or entity.

h. You agree that you have accepted these Terms and Conditions based on your own judgment, not on any representation or warranty made by the cafe.

3. CONVERSATIONS – THE CAFE

a. The Cafe complies with its obligations under the Privacy Act 1993 (NZ).

b. The Cafe uses its best efforts to protect the security of your information.

c. Technical services may be subject to errors, bugs, or other unexpected issues.

d. Delivery times are estimates and may change due to unforeseen circumstances.

e. The Food Provider is not responsible for warranties related to goods delivered by third-party partners.

4. METHODS OF PAYMENT

a. Payment must be made either:

• In cash upon collection, or
• By credit/debit card upon order completion (as applicable).

b. If paying by credit card, your order will not be processed or delivered until payment is approved.

5. ORDER PROCESS

a. Barring unforeseen circumstances, once your online order is processed, it will be delivered within the specified time or available for collection, including via third-party delivery partners.

b. You will receive an electronic confirmation upon order processing.

6. DELIVERY

a. You understand that:

i. Deliveries to flats/apartments must be received by a resident and cannot be left in common areas.
ii. The delivery partner is responsible for ensuring satisfactory delivery.
iii. A tax invoice with all charges will be provided at delivery or pick-up.
iv. Delivery may be refused if your address is outside the service area.
v. You are responsible for your order if collecting by pickup.
vi. Delivery times may vary due to traffic, weather, etc.
vii. Any issues must be raised with the Food Provider or delivery app partner.

b. If your order is delivered or picked up in unsatisfactory condition, report it to your delivery partner immediately.

7. REFUNDS

a. Under the Trade Practices Act 1993 (CGA), you may request a refund if the food is raw, uncooked, or excessively salty within 15 minutes of delivery.
No refunds will be provided after 15 minutes.

b. Refund requests for online orders must be made to the delivery partner. For direct orders, contact the cafe/restaurant.

c. Refunds will be issued using the same payment method, if the complaint is validated.

d. If approved, refunds will be processed within 24–48 hours.

e. The Food Provider reserves the right to discontinue service at any time without prior notice.

f. Orders cannot be cancelled or refunded once the food is prepared.

g. Complaints made within 15 minutesof delivery or pickup may result in a refund or replacement.

8. CANCELLATION

a. Orders can only be cancelled at the discretion of the Food Provider or delivery partner. You must contact them directly.

b. Orders may be cancelled at any time by notice via phone or email.

c. Orders may be cancelled due to food/beverage unavailability, and the customer will be informed.

9. LIABILITY AND LIMITATION OF LIABILITY

a. Food and beverages remain the property of the Food Provider until payment is confirmed.

b. After delivery, you are responsible for any spillage or damage.

c. Conversations – The Cafe is not liable for:

i. Your access to or use/inability to use the website.
ii. Your liability to third parties.
iii. Failure to deliver goods for any reason.
iv. Any modification or alteration of goods by others.

10. TERMINATION

a. Conversations – The Cafe reserves the right to:

• Decline your order
• Terminate your access to the website
• Remove you as a user
• Prevent further access
  if you breach these Terms. You must cease use immediately.

11. GOVERNING LAW

a. This Agreement is governed by the laws of New Zealand. All parties irrevocably submit to the exclusive jurisdiction of the New Zealand courts.
